Part two in a series…
We covered in…
We covered in yesterday’s Dash the importance of knowing what type of court you are in; so in case you missed that edition you may want to go read that one first, because we will be building from there with today’s information. Here is the direct link to that edition. Ya’ll hurry back, I’ll wait on you.
Yesterday I said…
Yesterday I said that some you might think that I have lost my mind but that is completely incorrect, what I’ve done is cleared my mind from all the garbage that had been placed in there over the years.
To understand how we got to this place and time here in the USA would take me a long damn while to explain in complete detail but there are some key points one must realize in order to understand where we were and how to get back there. So I am going to briefly give you some key points, corner posts if you will, on which we need to build from.
* Government was created by man. The purpose was to protect the liberty and property of man.
* Common law was in place before the United States was constituted in 1787 and is the law of the land.
* Common law is also known as the unwritten law because it basic and simple, which is how law should be.
* Common law has never been outlawed; it has been forced into dormancy by the use of codes and statutes along with the government controlled courts.
Those four corner…
Those four corner posts I listed have either been forgotten by us here in the USA or have never been known by us who are currently alive here. The further and further time went on from 1787 the less and less people remembered the true purpose government was created for.
Because of the human nature of man is to be trusting; over time we’ve let some very untrustworthy men with the reins of government. The government was given two jobs to do, protect the liberty and property of man. Let’s tackle the first job the government was given; protecting liberty of the “people”. “People”; as in we the people also know and referred to as “man”.
So what exactly…
So what exactly is “liberty”? Do most people even know the definition of liberty? I’ll answer my second question first because I’m running this show here today and I can do as I please. I don’t believe that most people know the definition of liberty.
Now I’ll get the first question clarified as to what exactly liberty is. For that clarification we’ll go to Bouvier’s online law dictionary: “LIBERTY. Freedom from restraint. The power of acting as one thinks fit, without any restraint or control, except from the laws of nature.”
Where do you...
Where do you see in that definition anything that has to do with following government rules and regulations? There is not one damn mention of it. In fact, the only thing putting restraint on us is the government; for the most part. So our government had two jobs to perform and they have failed at the first one for sure.
The reason for the failure is solely to blame on us and our ancestors before us here. I can’t make it any plainer than that. We have the burden now to correct the government or live with loss of our liberty. I don’t know about you; but I’m for correcting the government. I am doing my part by pointing out ways to slowly gain back that liberty but it will be up to you to embrace the ideas and both implement them in your life and pass them along to other uninformed people you associate with.
Let’s take a...
Let’s take a look at the second part of the government’s job which is to protect our property. In case you aren’t sure just what property is we’ll take a look for the legal definition of property. Again, we will use Bouvier’s Law dictionary for the meaning, PROPERTY. The right and interest which a man has in lands and chattels to the exclusion of others. 6 Binn. 98; 4 Pet. 511; 17 Johns. 283; 14 East, 370; 11 East, 290, 518. It is the right to enjoy and to dispose of certain things in the most absolute manner as he pleases, provided he makes no use of them prohibited by law. See Things.
2. All things are not the subject of property the sea, the air, and the like, cannot be appropriated; every one may enjoy them, but he has no exclusive right in them. When things are fully our own, or when all others are excluded from meddling with them, or from interfering about them, it is plain that no person besides the proprietor, who has this exclusive right, can have any, claim either to use them, or to hinder him from disposing of them as, he pleases; so that property, considered as an exclusive right to things, contains not only a right to use those things, but a right to dispose of them, either by exchanging them for other things, or by giving them away to any other person, without any consideration, or even throwing them away. Rutherf. Inst. 20; Domat, liv. prel. tit. 3; Poth. Des Choses; 18 Vin. Ab. 63; 7 Com. Dig. 175; Com. Dig. Biens. See also 2 B. & C. 281; S. C. 9 E. C. L. R. 87; 3 D. & R. 394; 9 B. & C. 396; S. C. 17 E. C. L. R. 404; 1 C. & M. 39; 4 Call, 472; 18 Ves. 193; 6 Bing. 630.”
Well that’s a pretty lengthy definition and I didn’t include the complete definition because it would just take up to much space and the main points of property are included in these two portions of it.
So the government should be protecting our property and about the only place I can think of where they are actually doing it is patent laws and copyright laws. Other than those it is very questionable if they are protecting our property.
I can think of plenty of scenarios where the government is actually stealing our property instead of protecting it.
In the old...
In the old days when cowboys and Indians were around the towns had a sheriff that would “keep the peace” , that was his job. We still have county sheriffs to this day, some actually try to protect people and their property and I commend them for doing so. But as government grew at the hands of corrupt government officials the sheriffs’ just could not keep up with demands put on them.
Those demands were from the people for protection, which is their job, but also from the corrupt officials to rob the people of their liberty and property.
As cities grew those officials took it upon them to create their own “policy enforcers” which we know by the name “police”. Those “policies” are the codes and statutes you previously thought were “law”. Quite often you’ll see on the police vehicles the words, “To Serve and Protect”, the question is just who are serving and protecting?
For the most...
For the most part the police are good men, just ignorant of what they are doing for the most part, because they have been trained by the same government that they are actually protecting. That is where the protecting part of their slogan comes from in my opinion, as well as the serving part too.
Codes and statutes are the antithesis of liberty. Remember that, embed that in your mind, because every time you get ticketed for some traffic violation or other code violation a piece of what liberty you thought you had was just taken away from you.
Slowly but surely the government moved us from a common law nation, where the people had the say as to what is right or wrong, to a nation who’s people believe codes and statutes are law. This was done with careful and deceitful planning on our elected officials’ part over the course of our history. One thing you can rest assured on is that nothing “happens” in government that isn’t planned and calculated to give the government the intended result those in power want.
The government of the USA has failed on both jobs they were created for doing, and have done so intentionally it seems to me.
I think we are going to end this segment right here. Tomorrow I will fully explain just what is “common law” and more.
Important points to remember: Liberty and property. Government was created to protect those; not steal them from you.
We’ll continue this tomorrow, the good Lord willing.
Until next time,
Sult
PS: “Ignorance of the ‘law’ is no excuse.” You’ve heard plenty of times in your life most likely. That is something you should ponder, now that you know codes and statutes aren’t “law”.
