"Property of unexplained origin: SPD [a German political party] wants to reverse burden of proof."
I read the above in May in this article [in German language] and hoped at first that this party which always when in doubt decides in favor of bureaucracy, control and surveillance of the citizens but against civil rights, liberties and self-determination, wouldn't succeed with its suggestion. Unfortunately it seems to be possible now that my fears were justified - especially also concerning the treatment of crypto currencies.

To begin with I would like to summarize my thoughts concerning the suggestion of the SPD:

Under the pretext to enter "heroically" the fight against black money and tax fraud, the SPD suggested that it should be possible to simply confiscate property whose origin is not verifiable (any more). Already these days I feared that this idea would meet with rather much agreement (as you know one has to fight against tax defrauders with all available agents ...). The patterns of argument proceed in a similar way like in case of the gapless surveillance of private communication (which allegedly exclusively serves the fight against terrorism). But in my opinion it isn't acceptable at all because it is intended to simply reverse the burden of proof: it wouldn't be necessary for the state anymore to prove that someone has committed a crime but rather the citizen would have to prove not to be guilty. I wonder what would happen for example to a person who had saved cash money every month for years without to keep a record of it (why should he)? Does he own confiscable money of unexplained origin now?

So far, so bad, but just now I read the article "All countries should think about to inaugurate the statutory offense of unexplained wealth" [in German language] in the BitcoinBlog which points to the same direction like the suggestion of the SPD, just in a bigger, global scale. At present also this is only a suggestion, but I suspect bad ... The text continues with: "At a conference in Doha, the capital of Qatar, several hundreds of officials of the international police authorities discussed money laundering and virtual currencies." Their advice to the governments was "to think about to inaugurate the statutory offense of unexplained wealth."

Should the constitutional principle to decide in case of doubt in favor of the accused be turned definitely into "In doubt against the accused (even without concrete suspicion)."?
How about to begin instead of that at first with the politicians who always call for more and more restrictive laws which affect the normal citizen but who at the same time take gifts from lobbyists [in German language] and enjoy immunity?

"Vermögen unklarer Herkunft: SPD will Beweislast umdrehen."
Dies las ich im Mai in einem Heise-Artikel und hoffte zunächst, dass diese Partei, die sich im Zweifelsfall stets für Bürokratie, Kontrolle des Bürgers und Überwachung, aber gegen Bürger-, Freiheitsrechte und Selbstbestimmtheit einsetzt, damit nicht durchkommen würde. Leider scheint es nun im Bereich des Möglichen zu liegen, dass meine Befürchtungen begründet waren - und zwar ganz konkret auch den Umgang mit Kryptowährungen betreffend.

Zunächst möchte ich meine Gedanken bezüglich des SPD-Vorschlags zusammenfassen:

Unter dem Vorwand, sich "heldenhaft" am Kampf gegen Schwarzgeld und Steuerhinterziehung zu beteiligen, schlug die SPD vor, Vermögen, deren Herkunft nicht (mehr) eindeutig nachweisbar ist, einfach konfiszieren zu können. Ich fürchtete schon damals, dass dieser Vorstoß auf relativ viel Zustimmung treffen würde (man muss ja bekanntlich mit allen verfügbaren Mitteln gegen Steuerhinterzieher vorgehen ...). Die "Begründungsmechanismen" verlaufen ähnlich wie im Falle der immer lückenloseren Überwachung privater Kommunikation (die angeblich ausschließlich der Terrorismusbekämpfung dient). Meiner Meinung nach ist das aber überhaupt nicht akzeptabel, da einfach so die Beweislast umgedreht werden soll: Der Staat soll die Straftat nicht mehr nachweisen müssen, sondern der Bürger hat zu belegen, dass er keine begangen hat! Was ist dann z. B. mit dem Sparer, der jahrzehntelang jeden Monat etwas Bargeld zurückgelegt und nicht (warum auch?) Buch darüber geführt hat? Besitzt er nun konfiszierbares Vermögen nicht nachweisbarer Herkunft?

Soweit, so schlecht, aber gerade eben las ich im BitcoinBlog den Artikel “Alle Länder sollten darüber nachdenken, die Straftat des unerklärten Reichtums einzuführen.”, der auf ähnliche Ziele wie die der SPD, allerdings in einem größeren, globalen Maßstab, hindeutet. Auch das ist zunächst nur ein Vorschlag, aber ich ahne Schlimmes ... Im Text heißt es weiter: "Auf einer Konferenz in Doha, der Hauptstadt von Katar, haben einige hundert Beamte der internationalen Polizeibehörden Geldwäsche und virtuelle Währungen diskutiert." Ihr Rat an die Regierungen lautet, “darüber nachzudenken, die Straftat von unerklärtem Wohlstand einzuführen.”

Soll das rechtsstaatliche Prinzip, im Zweifel für den Angeklagten zu entscheiden, nun endgültig in ein "Im Zweifel gegen den (ohne konkreten Verdacht) Angeklagten." umgekehrt werden?
Wie wäre es stattdessen damit, erst einmal bei den Politikern selbst anzufangen, die sich ständig für immer restriktivere Gesetze stark machen, sich selbst aber nur zu gerne von Lobbyisten beschenken lassen und Immunität genießen?
