The AAX exchange stopped all withdrawals on November 12, 2022. The next day, it said it needed 7-10 days to perform a system update. After those 10 days, the Facebook and Youtube channels have been canceled and the user's account is still blocked with the balance visible.
This way the police can't charge AAX with fraud and legal action is needed to figure out if the users balance is just a number on a website or if the money is there but not withdrawable. If present, legal action can recover it and reimburse users, otherwise AAX will be checked by the police and could be accused of fraud.
We spoke to Italian lawyer Antonio del Vecchio about it in a Zoom conference and here is what he told us.
Create an association
An association of all AAX users requesting a refund should be created. To create the association it is necessary to write a statute, appoint a president and a secretary. The cost is up to €200 (if set at 100 it costs €2 per person). Lawyer helps us create it for free.
The investigation
The lawyer will ask the police whether the users' money is in their AAX wallet or has been deposited elsewhere without the users' consent. This information is only available if the police already have an investigation underway, so everyone is advised to report the incident to the police near their home.
Legal action
If the money is in the AAX wallet, the lawyer will ask to unblock the withdrawals for all class action participants. If, on the other hand, they have been deposited in other wallets or transformed into FIAT, he will initiate a criminal action to accuse AAX of fraud. Each user has the right to get their money back In both cases, plus a fine because AAX blocked them. The prosecution (to charge with fraud) and the civil action (to be reimbursed) will be carried out by the association rather than by each individual person, all included in the cost of the class action.

Countries where crypto is illegal can be compensated
Crypto is illegal in 9 countries but, by participating in a legal action in Italy, users' money can be recovered and refunded from Italy through a foreign wire transfer.
Only participants in the class action will be reimbursed
Those who participate in the class action will be reimbursed at the end of the legal action, while those who do not participate will have to do it themselves. The lawyer estimates a cost between 10,000 and 12,000 euros for individual cases.
How much it costs to participate in the class action
The cost is €200 per person, to be paid at two different times: €100 at the beginning to start the investigation and legal action, another €100 when the court case begins.
AAX prohibits class actions
I remembered this after the Zoom meeting because I re-read the AAX Terms and Conditions.
AAX asked each user to opt out of participating in class actions or they could not create an account. So users have to hire a lawyer each (spending €10,000 each) or have they lost their money? The lawyer was going to dinner and... you know how we Italians are when it comes to food. Anyway, even very annoyed, he answered me.
Italian law says:
does not integrate the requirement of specific written approval pursuant to art. 1341 paragraph 2 of the civil code the reference en bloc of all or most of the general contract conditions, including those that are not vexatious in nature, and therefore their indiscriminate subscription, since this method does not guarantee the weak contractor's attention to the clause unfavourable, as it is included among the others mentioned: it is in fact a method of approving the vexatious clause such as to make its perception objectively difficult.
I'll tell you what that means. AAX asked me to accept Terms and Conditions by ticking only one checkbox.
This makes it very difficult to understand the unfavorable terms of the contract between AAX and me. Italian law says that AAX should have let me read the refusal to participate in a class action and I should have accepted it individually, ticking a dedicated checkbox.
By making me accept all the conditions en bloc, I was unable to understand this unfavorable condition, therefore it is not valid! The class action in Italy can be done.
Who can join the class action and who can't
Section 14.3 of the agreement signed with AAX prevents the creation of a class action. The lawyer studied the Terms and Conditions and concluded that: “AAX has no right to restrict the action of users in case AAX commits a crime”. No KYC required
You do not need KYC on AAX to participate in the class action. It is sufficient to demonstrate that you have made transactions to AAX from a wallet where you have the KYC and you can prove that the money is yours.
If you belong to a state that can participate, follow these instructions

- Go to the Documents to upload in the Google Form topic and you will find the partecipation to the class action, the professional assignment, the instructions to pay the lawyer and the link to the Google Form in the attached messages
- Download the partecipation to the class action and the professional assignment, fill them out, sign them and save them in PDF format
- WARING: THIS POINT ONLY IF THE CLASS ACTION IS ALREADY CREATED. Download the instructions for the initial payment of €100 and execute it. Convert it to PDF or create a screenshot making sure the transaction ID is legible. You can also take a photo
- Fill out the Google Form and upload the documents when prompted
It will be checked that the data is entered correctly, after which the lawyer will receive your request, check the accreditation and, if everything is fine, you will be notified that you are participating.
I joined the legal action, now what do I do?
Follow the news on the Telegram group to stay updated on official communications and progress with documented evidence. You will be asked to fill in a second Google Form containing your bank details to credit you with the money at the end of the legal action

L'exchange AAX ha bloccato tutti i prelievi il 12 novembre 2022. Il giorno dopo ha dichiarato di aver bisogno di 7-10 giorni per eseguire un aggiornamento di sistema. Passati quei 10 giorni, i canali Facebook e Youtube sono stati cancellati e il conto degli utenti è ancora bloccato con il saldo visibile.
In questo modo la polizia non può accusare AAX di truffa ed è necessaria un'azione legale per capire se il saldo degli utenti è solo un numero su un sito web oppure se i soldi ci sono ma non sono prelevabili. Se ci sono, l'azione legale può recuperarli e rimborsare gli utenti. Se non ci sono, AAX subirà dei controlli da parte della polizia e potrebbe essere accusata di truffa.
Abbiamo parlato di questo con l'avvocato italiano Antonio del Vecchio in una conferenza Zoom ed ecco quello che ci ha detto.
Creare un'associazione
Dovrà essere creata un'associazione formata da tutti gli utenti di AAX che chiedono un rimborso. Per creare l'associazione occorre scrivere uno statuto, nominare un presidente e un segretario. Il costo è di massimo 200€ (se partecipano in 100 costa 2€ a persona). L'avvocato ci aiuterà a crearlo gratis.
L'investigazione
L'avvocato chiederà alla polizia se i soldi degli utenti sono nel loro wallet AAX oppure sono stati trasferiti altrove senza il consenso degli utenti. Queste informazioni sono ottenibili solo se la polizia ha già un'indagine in corso, perciò si consiglia a tutti di denunciare l'accaduto alla polizia vicino casa.
L'azione legale
Se i soldi sono nel wallet AAX, l'avvocato chiederà di sbloccare i prelievi per tutti i partecipanti alla class action. Se invece sono stati depositati in altri wallet oppure trasformati in FIAT, avvierà un'azione penale per incolpare AAX di truffa. Ogni utente ha diritto a riprendere i propri soldi In entrambi i casi, più una multa perché AAX li ha bloccati. L'azione penale (per accusare di truffa) e quella civile (per essere rimborsati) saranno svolte dall'associazione invece che da ogni singola persona, tutto incluso nel costo della class action.

Le nazioni dove la cripto è illegale possono essere risarcite
La cripto è illegale in 9 nazioni ma, partecipando a un'azione legale in Italia, i soldi degli utenti possono essere recuperati e rimborsati dall'Italia attraverso un bonifico estero.
Solo i partecipanti alla class action saranno rimborsati
Chi partecipa alla class action sarà rimborsato al termine dell'azione legale, mentre chi non parteciperà dovrà fare da solo. L'avvocato stima un costo tra i 10000 e i 12000 euro per cause singole.
Quanto costa partecipare alla class action
Il costo è di 200€ a persona, da pagare in due momenti diversi: 100€ all'inizio per avviare l'investigazione e l'azione legale, altre 100€ quando inizierà la causa in tribunale.
AAX vieta le class action
Questa cosa me la sono ricordata dopo l'incontro con Zoom perché ho riletto i Termini e Condizioni di AAX.
AAX ha chiesto a ogni utente di rinunciare a partecipare ad azioni collettive o class action oppure non avrebbe potuto creare un account. Quindi gli utenti devono assumere un avvocato ognuno (spendendo 10000€ a testa) oppure hanno perso i loro soldi? L'avvocato stava andando a cena e... sapete come siamo fatti noi italiani quando si parla di cibo. Comunque, anche molto infastidito, mi ha risposto.
La legge italiana dice:
non integra il requisito della specifica approvazione per iscritto ex art. 1341 comma 2 c.c. il richiamo in blocco di tutte le condizioni generali di contratto o di gran parte di esse, comprese quelle prive di carattere vessatorio, e quindi la loro sottoscrizione indiscriminata, poiché con tale modalità non è garantita l’attenzione del contraente debole verso la clausola a lui sfavorevole, in quanto ricompresa tra le altre richiamate: trattasi infatti di una modalità di approvazione della clausola vessatoria tale da rendere oggettivamente difficoltosa la percezione della stessa.
Ti spiego cosa significa. AAX mi ha chiesto di accettare Termini e Condizioni spuntando una sola checkbox.
In questo modo risulta molto difficile capire le clausole sfavorevoli del contratto tra AAX e me. La legge italiana dice che AAX avrebbe dovuto farmi leggere il rifiuto di partecipare a una class action e io avrei dovuto accettarlo singolarmente, spuntando una checkbox dedicata.
Facendomi accettare tutte le condizioni in blocco, non sono riuscito a capire questa condizione sfavorevole, perciò non è valida! La class action in Italia si può fare.
Chi può partecipare alla class action e chi non può farlo
Il punto 14.3 del contratto sottoscritto con AAX impedisce la creazione di una class action. L’avvocato ha studiato i Termini e Condizioni e ha concluso che: “AAX non ha alcun diritto di limitare l’azione degli utenti nel caso sia AAX a commettere reato”. Non serve il KYC
Non serve il KYC su AAX per partecipare alla class action. E' sufficiente dimostrare che hai eseguito delle transazioni verso AAX da un wallet dove hai il KYC e potrai dimostrare che quei soldi sono i tuoi.
