For the last couple months I have been documenting our efforts to go after the surety bonds of elected/appointed officials here in Washington state. Our efforts started with Adam Swinyard the Superintendent of Spokane Public Schools. After requesting oath's of office and bonds/insurance policies we served Adam and the board of the district with a notice of claim as well as an affidavit of fact(view template here). Our next move was to do the same process with the second largest school district in the area, Central Valley School District.
Our requests for information revealed that Adam Swinyard of Spokane Public Schools did not have his oath properly filed. Ben Small of CVSD had his oath filed but as you'll see it appears he did not have is bond as required by RCW 28A.330.060.
I submitted my public records request with Jay Rowell, the assistant superintendent of of the district on February 8, 2022 at 6:15pm as you can see from this email in the outbox of my email with the time stamp indicated above.
After sending the above email I received a response on February 17, 2022 that included the oaths of office for all of the cvsd board members and superintendent Ben Small. You can view them here. Here is a copy of Ben Small's(cvsd superintendent) oath of office. Notice how the date is was signed July 1, 2008.
Fast forward to February 11, 2022 which is the date I was given to receive the official bond of Ben Small. Here is a copy of the bond for superintendent Ben Small of CVSD.
I ask you why would someone who took this position in 2008 not have a bond until 2022? Maybe there was a bond previous to this one that expired? Maybe the previous bond was used because Ben did not properly carry out his duties and damages were suffered to the district as a result. According to Washington law if one bond is used up the person required to have one may purchase a secondary bond. What do you think is this the case here or do you think superintendent Ben Small didn't acquire his bond as required by law and once attention was brought to it quickly acquired the bond that is required by law and filed it?
I have already put in another records request for a copy of the bond in place for Ben Small that was effective from July 1, 2008 until February 8, 2022. I have a feeling that request will result in no records found. What do you think?
