OpenAI CEO Sam Altman has warned that conversations you have with ChatGPT are not protected by legal confidentiality like those you would have with a therapist, doctor, or lawyer. Consequently, what you share with ChatGPT could potentially be used against you in legal proceedings, as OpenAI may be compelled to produce conversation records if subpoenaed or legally required to do so.
Altman noted that many people, especially young users, treat ChatGPT as a therapist or life coach, sharing deeply personal details, but unlike professional settings that offer doctor-patient or attorney-client privilege, there is currently no legal framework protecting privacy in AI conversations. He called this situation as highly problematic and emphasized that the industry has yet to figure out how to offer the same confidentiality protections for AI chats.
Altman discussed these concerns in a podcast with Theo Von, highlighting the risk that personal data shared in ChatGPT might be accessed or required in court cases. He also pointed out that unlike confidential conversations with licensed professionals, AI-based chats do not enjoy legal privilege, which could lead to significant privacy risks for users using AI for emotional support or sensitive advice.
