
In a case argued before the US Supreme Court on Wednesday, the Biden Administration, along with attorneys general from nine states, submitted arguments asking the justices to uphold warrantless home entry and gun confiscation by police.
A couple of thoughts here. First, the 4th Amendment is supposed to protect us from unreasonable search and seizure. Among other things, that has historically meant that the police need a warrant issued by a judge to enter your home and search it. The police need probable cause. Not "maybe something is wrong" or "this one person said blah blah blah". "Probable" cause. Sure, if the police hear gunshots from inside the house, that could be reasonably construed as probable cause. But unless there is some immediate and obvious reason to enter, they better get a warrant issued by a judge.
Second, it seems like Republican administrations get all the blame for this kind of crap. They are the fascists. Yet here we see the Biden administration arguing for this kind of power. Is it supposed to be OK because they will use it wisely? That's nonsense of course. Don't get me wrong, I'm not trying to defend the Republicans. Just trying to illustrate how this abuse of power (and virtually all others) is a problem on both sides. It's about the government having too much power. Not which side wields that power.
