How can we conduct a philosophical analysis of Positivism and Naturalism within the laws of the Hive?
Montesquieu argued that, to preserve freedom and avoid despotism, political power should be divided into three distinct branches: the Legislative Branch (which makes laws), the Executive Branch (which enforces them), and the Judiciary Branch (which judges). The essence of "checks and balances" lies in the idea that each of these branches must be independent, but also capable of "curbing" or "balancing" the others, preventing any of them from becoming excessively powerful and abusing their authority. Today, we're going to talk about self-voting and circle jerking. Two situations that some argue against, some argue for, and some don't understand enough to offer an opinion. I understand enough to comment, but I won't do so in this post. Instead, I'll explain how it works, how the community reacts, and the social/philosophical aspects of this discussion.
The fact that the code doesn't prohibit circle jerking or self-voting can be seen as the "legislative branch" of the blockchain. The code defines what is technically possible and permitted. It establishes the fundamental "laws" of the system.
Those who practice circle jerking and self-voting abusively are exploiting loopholes or permissiveness in the code to maximize their gains in a way that the community perceives as unfair or detrimental to the common "reward pool." They represent a form of "excess" or "abuse" within the system. The "milk" (reward) is finite, and exploitation by a few can deplete or discourage contributions by the many.
Downvoting is the most direct "check" and "balance" tool in this scenario. It's an action that reduces the other user's rewards and can even impact their reputation. Whales, who hold large amounts of Hive Power, have significant influence in their downvotes. They act as a sort of informal "guard" of the community's "morality." Their actions are not sanctioned by a formal court, but by their influence and the ethical consensus (or at least tacit acceptance, or tacit fear of being targeted) of a significant portion of the community. They exercise both "executive power" and "judicial power" over conduct.
The justification of protecting the reward pool is the philosophical basis of the "brake." If the pool is abused, it becomes less attractive to new users and original content creators, potentially leading to the collapse of the system or a decrease in quality. I apologize if this comparison sounds frivolous, but we can currently see the price of Hive and the Blurt network token, for example (for those unfamiliar, Blurt is a kind of Hive without the downvote option).
The code may not prohibit you from self-voting or circle jerking, but the community, through its actions and the HP, imposes an ethic that transcends the mere legality of the code. It's the "spirit of the law" (of the community) over the "letter of the law" (of the code).
The Hive community has an implicit "social contract." While the code establishes the ground rules, the tacit expectation is that participants act in ways that benefit, or at least don't seriously harm, the whole. When someone abuses the pool, they are violating this implicit social contract, and the downvote is the community's informal sanction against this violation.
Now that we understand that there is the letter of the law, or Positive Law, and the spirit of the law, Natural Law, let's move on to the philosophical part.
For a positivist, the morality of an action doesn't make it illegal unless the law explicitly prohibits it.
To understand what is meant by jurisprudence, we need to understand, for example, what is meant by a book of jurisprudence. A book of jurisprudence can have only one or the other of two objectives: 1. To determine what the law is; 2. To determine what it ought to be. In the first case, it can be called a book of expository jurisprudence; in the second, a book of censorial jurisprudence; or, in other words, a book on the art of lawmaking. [2]
The subject of jurisprudence is positive law: law, simply and strictly so called: or law established by political superiors for political inferiors. [3]
The pending laws of a modern legal system are not orders backed by threats, but rather rules that confer powers, public or private, or create facilities for the exercise of such powers. [4]
For a naturalist, there are universal and inherent moral principles that are superior to laws created by men. A law that contravenes these natural principles can be seen as unjust or illegitimate.
Every human law has the nature of law insofar as it derives from the law of nature. If, however, it diverges in any way from the natural law, it is no longer a law, but a corruption of the law. [5]
The state of nature has a law of nature to govern it, which binds everyone: and reason, which is this law, teaches all humanity, who will only consult it, that, since all are equal and independent, no one should harm another in his life, health, liberty, or possessions. [6]
This exercise of judgment also includes the rational distribution to each man, or to each social group, of the things that are properly theirs, so as to give preference sometimes to the wiser over the less wise, sometimes to a relative over a stranger, sometimes to a poor man over a man of means, according to the conduct of each or the nature of the thing. (...)
What we have said would have a degree of validity even if we conceded what cannot be conceded without the utmost perversity, that there is no God, or that the affairs of men do not concern Him. [7]

A essência dos "freios e contrapesos" reside na ideia de que cada um desses poderes deve ser independente, mas também capaz de "frear" ou "equilibrar" os outros, impedindo que qualquer um deles se torne excessivamente poderoso e abuse de sua autoridade. Vamos conversar hoje sobre self-vote e circle jerking. Duas situações que há pessoas que argumento contra, a favor e alguns que não entendem suficiente do tema para emitir uma opinião. Eu entendo o suficiente para emitir, mas não será nessa publicação que o farei, e sim explanarei sobre o funcionamento, como a comunidade reage e a questão social/filosófica dessa discussão.
O fato de o código não proibir circle jerking ou self-voting pode ser visto como o "Poder Legislativo" da blockchain. O código define o que é tecnicamente possível e permitido. Ele estabelece as "leis" fundamentais do sistema.
Aqueles que praticam circle jerking e self-voting de forma abusiva estão explorando as brechas ou a permissividade do código para maximizar seus ganhos de forma que a comunidade percebe como injusta ou prejudicial à "pool de recompensas" comum. Eles representam uma forma de "excesso" ou "abuso" dentro do sistema. O "leite" (recompensa) é finito, e a exploração por poucos pode esgotar ou desincentivar a contribuição dos muitos.
O downvote é a ferramenta de "freio" e "contrapeso" mais direta nesse cenário. É uma ação que diminui as recompensas do outro usuário e pode até mesmo impactar sua reputação. As Baleias que são os detentores de grande quantidade de Hive Power têm um peso significativo em seus downvotes. Eles funcionam como uma espécie de "guarda" informal da "moral" da comunidade. Sua ação não é sancionada por um tribunal formal, mas pela sua influência e pelo consenso ético (ou pelo menos pela aceitação tácita, ou medo tácito de virar alvo) de uma parte significativa da comunidade. Eles exercem um "poder executivo" e um "poder judiciário" sobre a conduta.
A Justificativa de proteger a pool de recomepnsa é a base filosófica do "freio". Se a pool for abusada, ela se torna menos atraente para novos usuários e para os criadores de conteúdo original, potencialmente levando ao colapso do sistema ou à diminuição da qualidade. Me desculpe a comparação se soar leviana, mas podemos ver atualmente o preço da Hive e do token da rede Blurt por exemplo (pra quem não conhece, a Blurt é uma espécie de Hive sem opção de Downvote).
O código pode não proibir você de fazer self-vote ou praticar circle jerking, mas a comunidade, através de suas ações e do HP, impõe uma ética que transcende a mera legalidade do código. É o "espírito da lei" (da comunidade) sobre a "letra da lei" (do código).
A comunidade Hive tem um "contrato social" implícito. Embora o código estabeleça as regras básicas, a expectativa tácita é que os participantes ajam de forma a beneficiar, ou pelo menos não prejudicar gravemente, o todo. Quando alguém abusa da pool, essa pessoa está violando esse contrato social implícito, e o downvote é a sanção informal da comunidade contra essa violação.
Agora que já entendemos que há a letra da lei, ou o Direito Positivo, e o espírito da lei, o Direito Natural, vamos para a parte filosófica.
Para um positivista, a moralidade de uma ação não a torna ilegal, a menos que a lei explicitamente a proíba.
Para saber o que se entende por jurisprudência, precisamos saber, por exemplo, o que se entende por um livro de jurisprudência. Um livro de jurisprudência pode ter apenas um ou outro de dois objetivos: 1. Determinar o que é a lei; 2. Determinar o que ela deveria ser. No primeiro caso, pode ser denominado um livro de jurisprudência expositiva; no segundo, um livro de jurisprudência censória; ou, em outras palavras, um livro sobre a arte de legislar. [2]
A questão da jurisprudência é o direito positivo: direito, simples e estritamente assim chamado: ou direito estabelecido por superiores políticos para inferiores políticos. [3]
As leis pendentes de um sistema jurídico moderno não são ordens apoiadas por ameaças, mas sim regras que conferem poderes, públicos ou privados, ou criam facilidades para o exercício de tais poderes [4]
Para um naturalista existem princípios morais universais e inerentes que são superiores às leis criadas pelos homens. Uma lei que contraria esses princípios naturais pode ser vista como injusta ou ilegítima.
Toda lei humana tem natureza de lei na medida em que deriva da lei da natureza. Se, porém, em algo diverge da lei natural, já não será lei, mas corrupção da lei. [5]
O estado de natureza tem uma lei da natureza para governá-lo, que obriga a todos: e a razão, que é essa lei, ensina a toda a humanidade, que apenas a consultará, que sendo todos iguais e independentes, ninguém deve prejudicar outro em sua vida, saúde, liberdade ou posses. [6]
A este exercício de julgamento pertence, além disso, a distribuição racional a cada homem, ou a cada grupo social, das coisas que são propriamente suas, de modo a dar preferência ora àquele que é mais sábio em detrimento do menos sábio, ora a um parente em vez de um estranho, ora a um homem pobre em vez de um homem de posses, conforme a conduta de cada um ou a natureza da coisa sugerir.

O que temos dito teria um grau de validade mesmo se concedêssemos o que não pode ser concedido sem a máxima perversidade, que não há Deus, ou que os assuntos dos homens não Lhe dizem respeito. [7]
