Todos hemos sido testigos y muchos hemos quedado preocupados por las noticias sobre el desmantelamiento de la web de Samurai Wallet y la acusación penal sobre sus creadores, así como la situación de la SEC con Metamask. Todo parece formar parte de un esfuerzo coordinado para atacar la autocustodia de criptomonedas y sentar las bases y precedentes legales para perseguir judicialmente a cualquier empresa o persona. Los estados, independientemente de la ideología política que defiendan, han buscado en su mayoría extender su poder estatal a través de la burocracia, el control y limitación de libertades de los pueblos. También incentivan una situación de dependencia prohibiendo actividades o acciones de los ciudadanos, forzándolos a requerir un servicio gubernamental en caso lo deseen ejecutar.
Este proceso de control y regulación se ha visto incrementado a medida que la vida se ha vuelto más digital y por tanto hay más trazas y mecanismos para vigilar. Es poco probable que la privacidad se vuelva completamente ilegal en el futuro, no habrá una ley prohibiéndola explícitamente. Sin embargo, es posible que veamos una erosión gradual de la privacidad a medida que los gobiernos buscan nuevas formas de vigilarnos y controlar la información. Pueden crear leyes prohibiendo el efectivo, limitando a un mínimo irracional el envío de dinero entre personas sin un justificante legal previo, prohibiendo el intercambio p2p de activos o exigiendo licencias para poder ejecutarlos, etc. Por muy absurda que parezca la idea, créeme, es posible.
Los cambios serán graduales, y en muchos casos basados en justificaciones lógicas de modo que las personas no tendrán capacidad de reacción hasta que se encuentren bajo una dictadura tecnocrática.

También hemos visto un aumento en el uso de tecnologías de reconocimiento facial y otras tecnologías de vigilancia que pueden utilizarse para rastrear a las personas y controlar sus movimientos. En este último aspecto el caso de China y su crédito social es preocupante, sobre todo cuando la Unión Europea se plantea implementar una variante de este sistema de control. El escenario de la película Minority Report es cada vez más una posibilidad real. Pronto cometer un crimen no será necesario para ir a prisión o ser castigado, solo será necesario que un algoritmo determine que eres proclive a ello. El intrusismo estatal en la vida y el libre albedrío podrían llevarnos a un escenario tipo matriz donde puedes ser castigado por pensar o desear algo diferente. Suena conocido, ¿no? Increíble que luego de tanto combatir el comunismo se empiecen a utilizar desde Occidente sus mismos mecanismos coercitivis de control a la libertad individual.
A pesar de que todavía existen fuertes protecciones legales para la privacidad en muchos países, la Cuarta Enmienda de la Constitución de los Estados Unidos, cada vez más estas son vulneradas en nombre de la Seguridad Nacional.
En respuesta a la pregunta, ¿será la privacidad ilegal en el futuro? Solo puedo decir que es importante estar atento a las tendencias actuales y defender nuestros derechos de privacidad.

In this latter aspect, China's social credit system is concerning, especially as the European Union considers implementing a variant of this control system. The scenario from the movie Minority Report is becoming more of a real possibility. Soon, committing a crime will not be necessary to go to prison or be punished; it will only be necessary for an algorithm to determine that you are prone to it. State intrusion into life and free will could lead us to a matrix-like scenario where you can be punished for thinking or desiring something different. Sounds familiar, doesn't it? It's incredible that after fighting communism for so long, the same coercive control mechanisms are starting to be used in the West.
Although there are still strong legal protections for privacy in many countries, such as the Fourth Amendment of the United States Constitution, these are increasingly violated in the name of National Security.
